Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and GetNear ("GetNear," "we," "us," or "our"), governing your access to and use of the GetNear mobile application and associated services (collectively, the "Service").

By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and any additional guidelines or policies referenced herein. These Terms apply to all users, including Buyers, Sellers, and any visitors to our website.

We reserve the right to modify these Terms at any time. Continued use of the Service after notification of changes constitutes your acceptance of the revised Terms.

GetNear is a hyperlocal marketplace platform that connects buyers seeking products with nearby sellers who stock those products. The Service enables:

• Buyers to post product inquiries broadcast to nearby registered sellers
• Sellers to respond to inquiries indicating product availability
• Buyers to discover, contact, and visit nearby sellers
• Users to voluntarily participate in a blood donation matching feature to connect willing donors with people in need
• Users to view and post local emergency requests for community assistance

To use GetNear, you must:

• Be at least 13 years of age
• Have the legal capacity to enter into a binding agreement
• Possess an Android smartphone with an active internet connection
• Not have been previously suspended or permanently banned from the GetNear platform

To use the blood donation feature, you must additionally self-declare that you are at least 18 years of age and in good health. GetNear does not independently verify these declarations.

By registering, you represent and warrant that all information you provide is accurate, current, and complete.

4.1 Account Registration

You may register using a valid email address and password, via Google Sign-In, or via phone OTP verification. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

4.2 Role Assignment

At registration, you select one permanent role — either Buyer or Seller. This role cannot be changed without administrator approval. Each user is permitted one account per role. Creating multiple accounts to circumvent platform rules or rate limits is prohibited.

4.3 Account Security

• You must not share your account credentials with any third party
• You are responsible for all actions taken through your account
• Sessions inactive for more than 30 days are automatically revoked for security
• OTP codes are valid for 5 minutes and must not be shared with anyone

4.4 Seller Verification

Seller accounts may apply for a "Verified" badge through the administrator review process. Verification indicates that GetNear has reviewed the seller's submitted information but does not constitute an endorsement of the seller, their products, or their business practices.

5.1 Accurate Profile Information

You must provide accurate, complete, and up-to-date information in your shop profile, including shop name, address, phone number, and product categories. You must promptly update your profile if any information changes.

5.2 Response Integrity

Availability responses must be honest and accurate. You may only respond with affirmative availability statuses if you genuinely stock or can immediately source the product. Responding with false availability to attract buyers constitutes a violation of these Terms.

5.3 Lawful Goods Only

You may only offer products that are legal to sell under applicable Indian law. You must not use GetNear to facilitate the sale of counterfeit, stolen, prohibited, or regulated goods without proper licensing.

5.4 Professional Conduct

You must treat all buyers courteously and professionally. Any form of harassment, discrimination, or threatening behaviour towards buyers is strictly prohibited and will result in immediate account suspension.

5.5 No Off-Platform Solicitation

You must not use buyer contact information obtained through GetNear to solicit purchases outside the platform or to market unrelated products and services.

6.1 Genuine Inquiries Only

Submit inquiries only for products you genuinely intend to purchase. Submitting fake, test, or spam inquiries wastes sellers' time and is a violation of these Terms.

6.2 Rate Limits

You are limited to 10 inquiries per 24-hour rolling window. You may not submit a new inquiry in the same product category if an active inquiry already exists. These limits exist to protect sellers from notification fatigue.

6.3 Accurate Location

Your inquiry location must reflect your actual current location. Manipulating or spoofing GPS coordinates to deceive sellers about your proximity is prohibited.

6.4 Respectful Conduct

You must treat all sellers courteously. Any harassment or abuse of sellers discovered through the platform is prohibited and will result in account action.

7.1 Voluntary Participation

Participation in the blood donation feature is entirely voluntary. No compensation, monetary or otherwise, is offered or permitted for blood donation facilitated through GetNear. Offering or accepting payment for blood donation through the platform is strictly prohibited.

7.2 Donor Self-Declaration

By registering as a potential donor, you self-declare that:

• You are 18 years of age or older
• You are currently in good health to the best of your knowledge
• You are donating voluntarily without coercion or monetary incentive
• You understand that final eligibility must be determined by medical staff at the donation site

7.3 Transport Assistance

If transport assistance is offered by a requester, this is a voluntary arrangement between the donor and the requester. GetNear is not a party to this arrangement, does not coordinate transport, and accepts no responsibility for transport-related outcomes.

7.4 No Medical Liability

GetNear assumes no liability whatsoever for any health outcomes, adverse reactions, injuries, or complications arising from blood donation facilitated through the platform. You participate entirely at your own risk.

7.5 Emergency Requests

Emergency blood requests are displayed to nearby users based on location proximity. These are community requests and GetNear does not verify the authenticity or urgency of any request. Users should exercise their own judgement when responding.

The following activities are strictly prohibited. Violation may result in immediate account suspension or permanent ban:

Misuse of Platform Features

• Submitting fake, spam, or test inquiries to flood sellers with notifications
• Creating multiple accounts to circumvent rate limits or bans
• Manipulating GPS coordinates to deceive other users about your location
• Responding to inquiries with false availability information
• Using automated scripts, bots, or scrapers to interact with the platform

Harmful or Illegal Content

• Uploading obscene, offensive, defamatory, or illegal content or images
• Content that discriminates on the basis of religion, caste, gender, ethnicity, or disability
• Impersonating another person or business
• Facilitating the sale or exchange of illegal, counterfeit, or stolen goods
• Offering or soliciting monetary compensation for blood donation

Platform Integrity

• Attempting to reverse-engineer, decompile, or tamper with the application
• Attempting to circumvent Firebase security rules or authentication mechanisms
• Reporting other users in bad faith or as a form of harassment
• Collecting or misusing other users' personal data obtained through the platform

9.1 GetNear's IP

The GetNear name, logo, application design, user interface, and all software code are the intellectual property of GetNear and are protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our intellectual property without prior written consent.

9.2 User-Generated Content

You retain ownership of content you upload to GetNear (including inquiry descriptions, product images, and shop photos). By uploading content to the platform, you grant GetNear a non-exclusive, royalty-free, worldwide licence to store, display, and use that content solely for the purpose of operating the Service.

You represent and warrant that any content you upload does not infringe any third party's intellectual property rights and does not violate any applicable law.

10.1 No Warranty

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. GetNear does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10.2 No Endorsement of Users

GetNear does not endorse, verify (except through the voluntary verification programme), or vouch for any Buyer, Seller, or content on the platform. We are not responsible for the conduct of any user, the quality of any product, or the outcome of any transaction.

10.3 No Transaction Liability

All transactions between Buyers and Sellers are conducted entirely offline and independently of GetNear. We are not a party to any such transaction and accept no liability for disputes, non-delivery, defective products, personal injury, or financial loss arising from offline transactions.

10.4 Blood Donation Disclaimer

GetNear accepts no liability for any health outcomes, injuries, complications, or losses arising from blood donation activity facilitated through the platform. All medical decisions must be made in consultation with qualified healthcare professionals.

10.5 Limitation of Liability

To the fullest extent permitted by law, GetNear's aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed INR 1,000. GetNear shall not be liable for indirect, incidental, special, consequential, or punitive damages.

11.1 Termination by You

You may terminate your account at any time by using the in-app 'Delete Account' feature or by contacting us. Upon account deletion, all your personal data will be permanently purged within 30 days, subject to legal retention obligations.

11.2 Termination by GetNear

We may suspend or permanently ban your account without prior notice if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the platform or other users.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections on Intellectual Property, Disclaimers, and Governing Law survive termination along with any accrued rights or obligations.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India.

Before resorting to formal legal proceedings, we encourage you to contact us to resolve any dispute amicably.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
